Food Poisoning Settlement Collected by Simon & Luke

The food safety lawyers at Simon & Luke have obtained another food poisoning settlement – this time on behalf of a 42 year old woman who contracted Staphylococcus aureus poisoning after consuming pastries manufactured by Rolf’s Patisserie, a bakery located in Lincolnwood, Illinois.

Rolf’s was identified as the source of an outbreak in November and December of 2010 that sickened approximately 100 people in Illinois and Wisconsin.  The outbreak was attributed to pastries from the bakery that were tainted with Staphylococcus aureus.

The outbreak prompted Rolf’s to recall all desserts made after November 1, 2010.

The illnesses stemmed from four events in November and December.  Those events included a catered party, company function, holiday party, and restaurant dining.  The FDA announced that three events accounted for 30 cases in Illinois and one event accounted for 70 cases in Wisconsin.

Rolf’s recalled tiramisu, cakes, cobblers, decorated cookies, tarts, pastries, and pies.  The outbreak also caused Whole Foods Market to recall gingerbread houses from Rolf’s Patisserie.  The gingerbread houses were sold in 22 states.

The Illinois Department of Health closed Rolf’s Patisserie until the restaurant could be sanitized and all food workers tested and cleared for the bacteria.  was temporarily closed and is working with health officials to investigate the outbreak.
